SECTION 1 -
Defining the activity subject to Section 1(1) of the Rural Needs Act (NI) 2016

 

1A. Name of Public Authority.

Causeway Coast and Glens Borough Council.


 

1B. Please provide a short title which describes the activity being undertaken by the Public Authority that is subject to Section 1(1) of the Rural Needs Act (NI) 2016.

The development of a policy for the management of applications for street trading licences to permit trading within the district council area and enforcement of relevant legislation.


 

1C. Please indicate which category the activity specified in Section 1B above relates to.

1D. Please provide the official title (if any) of the Policy, Strategy, Plan or Public Service document or initiative relating to the category indicated in Section 1C above.

Street Trading Policy.

 

 

1E. Please provide details of the aims and/or objectives of the Policy, Strategy, Plan or Public Service.

By providing a framework for the processing of street trading applications, the enforcement of relevant regulations, including the procedures to be followed when determining applications, the policy will: promote consistency in the decision-making process; assist in ensuring that applications are dealt with as quickly and fairly as possible; provide clarity and transparency in Council’s decision-making process and give prospective applicants an early indication as to whether their application is likely to be granted or not; ensure that Council meets its legal obligations under the Act and the Provision of Services Regulations 2009.

Understanding the impact of the Policy, Strategy, Plan or Public Service

 

2A. Is the Policy, Strategy, Plan or Public Service likely to impact on people in rural areas?

Yes                  If the response is NO GO TO Section 2E.


 

2B. Please explain how the Policy, Strategy, Plan or Public Service is likely to impact on people in rural areas.

The policy is intended to apply across the whole district and will impact equally on people in urban and rural areas.

Applications may be made by persons from both rural and urban areas of the district and those applications may relate to street trading in both urban and rural areas. Enforcement actions may be taken in rural areas where offences are committed.


 

2C. If the Policy, Strategy, Plan or Public Service is likely to impact on people in rural areas differently from people in urban areas, please explain how it is likely to impact on people in rural areas differently.

The policy is not intended to impact on people in rural areas differently from those in urban areas – it will be applied equally across the whole district.


 

2D. Please indicate which of the following rural policy areas the Policy, Strategy, Plan or Public Service is likely to primarily impact on.

Jobs or Employment in Rural Areas.
Administration of street trading applications and enforcement of same.

Identifying the Social and Economic Needs of Persons in Rural Areas

No.          If the response is NO GO TO Section 3E.

This policy is not expected to have any impact upon the social or economic needs of people in rural areas.

 

 

SECTION 4 -
Considering the Social and Economic Needs of Persons in Rural Areas.

 

4A. Please provide details of the issues considered in relation to the social and economic needs of people in rural areas.

The Policy provides information on designating areas including rural areas for the purposes of street trading.
Should such a request for street trading designation be received from a rural location consideration will be given to the needs of people in rural areas including access to services and good and the benefits from new trade.

 

 

SECTION 5 -
Influencing the Policy, Strategy, Plan or Public Service

 

5A. Has the development, adoption, implementation or revising of the Policy, Strategy or Plan, or the design or delivery of the Public Service, been influenced by the rural needs identified?

No.      If the response is NO GO TO Section 5C.

 

5B. Please explain how the development, adoption, implementation or revising of the Policy, Strategy or Plan, or the design or delivery of the Public Service, has been influenced by the rural needs identified.

5C. Please explain why the development, adoption, implementation or revising of the Policy, Strategy or Plan, or the design or the delivery of the Public Service, has NOT been influenced by the rural needs identified.

This policy is designed to apply to the processing of applications and enforcement and is designed to apply equally across the whole district, impacting equally on rural and urban areas. The policy is already designed to facilitate the satisfactory receipt and processing of applications from all persons, irrespective of whether they live in rural or urban areas. Enforcement decisions do not take any consideration of offences occurring in either a rural or urban area.
